Vendor Responsibility

Take-Down Policy

Upon receiving a valid DMCA notification or other appropriate notice, ScholarOn.com will:

  1. Remove or Disable Access: Promptly remove or disable access to the allegedly infringing material.
  2. Notify the Vendor: Notify the vendor who uploaded the content that the material has been removed or disabled.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent with the following information in writing:

  1. Identification of the Removed Material: A description of the material that was removed or to which access was disabled and the location where the material appeared before it was removed or disabled.
  2. Statement of Good Faith: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Contact Information: Your name, address, telephone number, and email address.
  4. Statement of Consent: A statement that you consent to the jurisdiction of the federal court in your judicial district, or if your address is outside of the United States, in any judicial district in which ScholarOn.com may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Signature: A physical or electronic signature.
  6. Upon receiving a valid counter-notification, ScholarOn.com will:
  7. Notify the Original Claimant: Inform the original claimant that the material will be restored or access re-enabled.
  8. Restore the Material: Restore the removed material or re-enable access to it after 10 business days if the original claimant does not file a court action to restrain the vendor from engaging in infringing activity related to the material.

Repeat Infringers

ScholarOn.com may, in appropriate circumstances, terminate the accounts of vendors or users who are repeat infringers.
